1. Introduction and Scope Second Sight Psychiatric Care
("the Practice," "we," "us," or "our") provides psychiatric care to patients and operates a website located at vermontpsychiatry.com (the "Site"). This Privacy Policy explains how we collect, use, and protect information from visitors to the Site, including individuals who subscribe to our email newsletter. It applies to all visitors, regardless of location, and specifically addresses the additional protections afforded to residents of Vermont and Utah, the two states in which we operate or direct our services. This Policy covers general website and marketing data. It does not cover Protected Health Information ("PHI") that we create or receive as part of providing clinical care. Our handling of PHI is instead governed by our HIPAA Notice of Privacy Practices, available at [LINK TO NOTICE OF PRIVACY PRACTICES] and provided to all patients at intake. If you are a current or prospective patient and have a question about your clinical records, that Notice — not this Policy — controls.
2. Information We Collect
2.1 Information You Provide Directly
• Newsletter sign-up: name and email address, and any preferences you select when subscribing.
• Contact and intake forms: name, email address, phone number, and the content of any message you send us (please do not include sensitive health details in a general contact form).
• Appointment requests: information you choose to provide when requesting an appointment through the Site.
2.2 Information Collected Automatically
• Device and usage data: IP address, browser type, operating system, referring URLs, pages viewed, and time spent on the Site.
• Cookies and similar technologies: used for site functionality, analytics, and (if enabled) measuring newsletter engagement such as opens and link clicks. See Section 6.
We do not knowingly collect Social Security numbers, insurance identifiers, or clinical/health information through the newsletter sign-up form or general website analytics.
3. How We Use Your Information
• To send the newsletter and respond to inquiries you submit.
• To operate, maintain, and improve the Site.
• To schedule appointments or route intake requests to appropriate staff.
• To comply with legal obligations and protect the security of our systems and patients.
• We do not sell your personal information, and we do not use newsletter subscriber data for third-party advertising.
4. The Newsletter: Consent, Content, and Opting Out
Subscribing to the newsletter is voluntary and requires your affirmative sign-up (we do not add website visitors automatically). Newsletter content is general psychiatric health education and practice updates; it is not individualized clinical advice, and subscribing does not create a patient relationship.
Consistent with the federal CAN-SPAM Act, every newsletter email will:
• Identify Second Sight Psychiatric Care as the sender with accurate, non-deceptive header and subject-line information.
• Include our valid physical postal address: 183 Talcott Road, Williston, VT 05495.
• Provide a clear, working unsubscribe mechanism, which we will honor within 10 business days.
You may unsubscribe at any time using the link in any newsletter email, or by contacting us using the information in Section 11. Unsubscribing from the newsletter does not affect appointment reminders or other communications related to your clinical care, which are governed separately by our Notice of Privacy Practices and your patient communication preferences on file.
5. Sharing and Disclosure of Information
We share website and newsletter data only as needed to operate the Site and the newsletter, and we require service providers to protect it. Categories of recipients may include:
• Email delivery / newsletter platform (Flodesk).
• Website hosting provider (e.g., GoDaddy) and website analytics providers (e.g., Google Analytics).
• Scheduling or practice-management software used to process appointment requests.
• Professional advisors, or government authorities, where required by law, subpoena, or to protect the safety of a patient or the public.
We do not sell, rent, or trade your personal information to third parties for their own marketing purposes.
6. Cookies and Analytics
This Site uses cookies and similar technologies for core functionality and to understand how visitors use the Site (for example, via Google Analytics). You can control or disable cookies through your browser settings; disabling cookies may limit some Site features. If we use email open/click tracking for the newsletter, that use is described here and can be avoided by disabling image loading in your email client.
7. Data Security and Retention
We use reasonable administrative, technical, and physical safeguards designed to protect website and newsletter data against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. We retain newsletter and contact-form data for as long as needed to operate the newsletter and respond to inquiries, or until you ask us to delete it, whichever comes first.
8. Your Privacy Rights
8.1 All Visitors Regardless of your state of residence, you may ask us at any time to: (a) tell you what personal information we hold about you from the newsletter or contact forms; (b) correct inaccurate information; or (c) delete your information and unsubscribe you from further contact. We will respond within a reasonable time, generally no later than 45 days.
8.2 Vermont Residents Vermont enacted the Vermont Data Privacy and Online Surveillance Act (VDPOSA) in June 2026, with an effective date of January 1, 2028. The law applies only to businesses meeting certain data-volume thresholds, and it exempts healthcare providers and facilities with respect to information maintained as Protected Health Information under HIPAA. Based on the size of our newsletter list and website traffic, we do not currently expect to meet the VDPOSA's applicability thresholds, but we will update this Policy and provide any additional required disclosures if that changes or as the law's effective date approaches.
8.3 Utah Residents Utah's Consumer Privacy Act (UCPA) applies to businesses with at least $25 million in annual revenue that also meet certain data-volume thresholds, and it exempts protected health information governed by HIPAA. As a small independent practice, we do not currently meet the UCPA's applicability thresholds. We nonetheless honor the access, correction, and deletion requests described in Section 8.1 for all newsletter subscribers and website visitors, including Utah residents, as a matter of practice.
8.4 How to Exercise Your Rights Submit a request using the contact information in Section 11. We may need to verify your identity before processing certain requests (for example, by confirming the email address associated with your subscription).
9. Children's Privacy
The Site's newsletter sign-up and contact forms are directed to adults and are not intended for children under 13. We do not knowingly collect personal information from children under 13 through the Site in a manner inconsistent with the Children's Online Privacy Protection Act (COPPA). If we learn that a child under 13 has submitted information through the Site, we will delete it. This section addresses website data collection only; it does not limit or describe how we may communicate with parents or guardians of minor patients as part of clinical care, which is governed by our Notice of Privacy Practices and applicable Vermont and Utah minor-consent law.
10. Third-Party Links
The Site may link to third-party websites, such as patient portals or payment processors, that we do not control. This Policy does not apply to those third-party sites, and we encourage you to review their privacy policies separately.

12. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices or applicable law, including the Vermont VDPOSA as it approaches its 2028 effective date. The "Last Updated" date at the top of this Policy will reflect the most recent revision. Material changes affecting how we use newsletter subscriber data will be communicated by email or a prominent notice on the Site.
